Terms of Service

FanKit is a web platform that helps businesses create and manage digital wallet experiences, customer programs, and related communications, including SMS and push campaigns.

You agree to provide accurate information, keep your account secure, and use the platform lawfully and responsibly. You are responsible for activity carried out through your account and by your team members.

You are also responsible for making sure you have the right to contact your customers, send them messages, and provide them with wallet passes or related updates.

By signing up for FanKit, you agree to follow the rules of the platform. Any activity that harms, abuses, overloads, probes, or negatively affects FanKit, our infrastructure, or the infrastructure of our providers may result in immediate suspension or termination without prior notice.

You may not use FanKit for illegal activity, fraud, impersonation, security abuse, spam, unsolicited campaigns, deceptive promotions, or any conduct that puts users, providers, or the platform at risk.

You are responsible for the content of your campaigns and for complying with all laws, regulations, carrier requirements, and consent rules that apply to your use of SMS, push messaging, customer data, and promotional communications.

FanKit may monitor SMS and push campaigns for legal, compliance, fraud-prevention, and platform-safety purposes. Any activity considered suspicious, illegal, spammy, misleading, or unsolicited may trigger immediate suspension and possible termination.

Apple and Google each maintain their own rules for how their wallet ecosystems may be used. You are responsible for knowing and following those rules. If your use of FanKit conflicts with Apple or Google policies, your account may be suspended or terminated without prior notice.

Paid features are billed through FanKit using our payment provider, Openpay. When you add a payment method, you authorize Openpay to store and process your payment details securely in accordance with its own terms and policies.

When you subscribe to FanKit Pro, you authorize recurring charges according to the billing cycle you selected. For monthly plans, this means you authorize a charge every month until cancellation. If you want to avoid the next charge, you must cancel before the next billing date.

All payments are final and non-refundable unless required by applicable law.

SMS credits are non-refundable and do not expire.

You are responsible for any taxes, fees, or charges associated with your use of the service unless the law requires otherwise.

FanKit depends on third-party providers, including payment, messaging, hosting, and wallet platform providers. We are not responsible for outages, rejections, delays, policy decisions, or service changes made by those third parties.

We do not guarantee that any SMS, push notification, or wallet pass will be delivered, accepted, displayed, or remain available on any third-party platform.

We may suspend, restrict, or terminate access to FanKit immediately if we believe you have violated these Terms, created risk for users or providers, failed to pay amounts due, or used the platform in a way that is illegal or harmful.

You may stop using FanKit at any time. Termination does not erase amounts already owed and does not create any right to a refund.

You keep ownership of the content, branding, campaign copy, and materials you upload to FanKit. You give FanKit a limited right to host, process, reproduce, and transmit that content only as needed to operate, secure, support, and improve the service.

FanKit and its related branding, software, and materials remain the property of TURBOSHIP SA DE CV or its licensors.

FanKit is provided on an "as is" and "as available" basis. To the maximum extent allowed by law, TURBOSHIP SA DE CV disclaims warranties of uninterrupted availability, merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent allowed by law, TURBOSHIP SA DE CV will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from your use of the service.

We may update these Terms from time to time. Continued use of FanKit after an update takes effect means you accept the revised Terms.
